Practice Areas

As a specialized litigation firm, MUDGAL ADVOCATES has consistently handled complex legal challenges requiring high-level strategic planning and execution. Our experience spans across various legal domains, with a focus on delivering results in high-stake environments.

Supreme Court Appeals and SLPs

  • The firm drafts and argues Special Leave Petitions and appeals before the Supreme Court of India, including interim relief and stay applications. In matters of particular complexity, the firm briefs and assists Senior Advocates with legal research, written submissions, and formulation of arguments for the hearing.

Writ Petitions and PIL

  • Challenges to government action, statutory violations, and infringement of fundamental rights through writ petitions before the Delhi High Court and the Supreme Court of India. The firm has also filed public interest litigation in matters affecting larger groups of persons.

Appellate Advocacy and Senior Briefing

  • The firm has substantial experience in briefing and assisting Senior Advocates in matters of significance before the Supreme Court of India and the Delhi High Court. This work involves extensive legal research, the preparation of comprehensive written submissions, and the formulation of the legal strategy to be advanced before the court. We specialize handling appellate proceedings before the Supreme Court of India and constitutional courts, with expertise in interpreting constitutional law, substantial questions of law, protecting fundamental rights, and providing public law remedies.

Service and Employment Disputes

  • Reinstatement, back wages, seniority, departmental inquiries, and terminal benefits before the High Court of Delhi, the Central Administrative Tribunal (CAT) and the Delhi School Tribunal. The factual records in service law cases are often dense, and reconstructing the correct sequence of events is frequently where the case is won or lost. Government employees, public servants and teachers form a substantial part of the firm's service law practice.

Civil and Property Disputes

  • Partition suits, title disputes, suit for possession, specific performance, recovery suits and suit for injunction across all District Courts in Delhi as well as the High Court of Delhi. Effective trial work in these matters requires careful management of documentary and oral evidence and sustained attention to procedural detail.

Consumer Disputes

  • The firm represents both individual consumers and corporate entities before Consumer Forums and Commissions at all levels, in matters concerning deficiency of service and unfair trade practices.

Matrimonial and Family Matters

  • Contested divorce proceedings, maintenance, child custody, and domestic violence cases. The firm has also brought several of these matters from contested litigation to settlement through sustained negotiation.

Intellectual Property

  • Trademark applications, oppositions, and rectification proceedings, as well as copyright registration and enforcement, before the IPR Registry. Where IP disputes proceed to the Delhi High Court, the firm handles those as well.

Arbitration and ADR

  • Arbitration proceedings under the Arbitration and Conciliation Act, 1996, including conduct of hearings and applications to set aside or enforce arbitral awards. The firm has also represented clients in mediation and conciliation where a negotiated resolution was preferable to contested proceedings.

Criminal Law

  • The firm handles trial representation in criminal matters before the District and Sessions Courts in Delhi. This covers bail applications, charge hearings, examination of witnesses, and final arguments. Over the years, the firm has represented clients in a wide range of cases, from financial offences under the Negotiable Instruments Act, PMLA, and IPC/ BNS fraud provisions to serious crimes including murder, robbery, sexual assault, kidnapping, and dacoity. The firm has also appeared in matters under the NDPS Act, Arms Act, POCSO, and cyber crime matters, handling each case from the first hearing through final disposal.
